Democrats claim Romney, Ryan broke bribery laws by giving out free subs http://www.620wtmj.com/news/local/146008395.html WAUKESHA - Wisconsin Democrats claim White House hopeful Mitt Romney and Congressman Paul Ryan violated state campaign bribery laws during Tuesday's election. Romney and Ryan passed out free, pre-made sandwiches at a Cousins Subs in Waukesha while the polls were open. "We're going to go to the polls today," Ryan told supporters. Romney urged supporters to vote. "Get some friends to go with you," Romney said during his remarks. "That's how you can legally vote multiple times, right? So bring your friends to the polling place. Get out and vote. If you want another sandwich, there are more back there." The Democratic Party of Wisconsin contends Ryan and Romney broke the law by distributing free subs. The party planned to file complaints with the Government Accountability Board and the Waukesha County district attorney's office. "If you take something of value that's more than a dollar and use it persuade someone to vote or encourage someone to vote, then it's illegal," party chair Mike Tate said at a press conference. Candidates are discouraged from offering food, beverage or other gift to get someone to vote or to thank them for a vote, GAB spokesperson Reid Magney said. Magney said while the board does not have all of the facts in this case, candidates run the risk of violating campaign bribery laws. The charging decision would be likely be up to DA Brad Schimel. "We have not received any complaint yet," Schimel said in an email. "I am on vacation and will deal with any formal complaint that comes in when I return. This has no urgency to it that would require me to act on it while I am on vacation with my family." Romney state campaign co-chair Ted Kanavas dismissed the complaint. "I wasn't bought off by a Cousins sub in Waukesha, Wisconsin. I think they should probably get a life," Kanavas said. Jeff Daane, a family owner of the Cousins franchise, said the campaign paid for the food. "Somebody wanted to come and by food from us and we were more than happy to provide that opportunity," Daane said. Rep. Ryan's office did not respond to a request for a comment. Violating the campaign bribery law is a low level felony and would have no impact on a candidates spot on the ballot, Magney said.

It is law, shouldn't candidates not break the law of the states they are visiting? I think receiving objects of value can definitely make some people more likely to vote. It won't swing anyone, really, but you should be encouraging people with ideas.

I don't know, but if those rides weren't in Wisconsin, then the specific law wouldn't apply: this is a state statute.
12.11 Election bribery. (1) In this section, "anything of value" includes any amount of money, or any object which has utility independent of any political message it contains and the value of which exceeds $1. The prohibitions of this section apply to the distribution of material printed at public expense and available for free distribution if such materials are accompanied by a political message. (1m) Any person who does any of the following violates this chapter: (a) Offers, gives, lends or promises to give or lend, or endeavors to procure, anything of value, or any office or employment or any privilege or immunity to, or for, any elector, or to or for any other person, in order to induce any elector to: 1. Go to or refrain from going to the polls. 2. Vote or refrain from voting. 3. Vote or refrain from voting for or against a particular person. 4. Vote or refrain from voting for or against a particular referendum; or on account of any elector having done any of the above. ... Whoever violates s. 12.09, 12.11 or 12.13 (1), (2) (b) 1. to 7. or (3) (a), (e), (f), (j), (k), (L), (m), (y) or (z) is guilty of a Class I felony. ... For a Class I felony, a fine not to exceed $10,000 or imprisonment not to exceed 3 years and 6 months, or both.
It sounds silly to me, too, presuming the sandwiches weren't a direct bribe for a specific vote, but Wisconsin law is quite specific and this is a clear violation. You can't pay them $1 even to persuade them to merely go to the polls.

It sounds like the courts took a very strict interpretation of the word "induce" in the statute. The whole law hinges on it. If one takes a strict interpretation closer to compulsion than enticement, then neither the BBQ nor the subs were illegal. I'm a linguist but not a lawyer, so I can't comment specifically on the legal interpretation of "induce" in this context; the linguistic interpretation hinges on the outcome of the induced, not the actions of the inducers, where the law must go by the actions of the inducers. (In other words, one is linguistically "induced" if one produces the desired result of going to the polls, and not "induced" if one does not, regardless of the efforts of those inducing.) It does seem clear that either neither or both of these actions were illegal. They are definitely highly similar. If the earlier BBQ ruling established precedent, then Romney and Ryan are in the clear.
