like if I give a car to someone, and the brakes go out and they hit a tree could I get sued? no this didn't happen, but I am thinking of giving my used car to a friend/coworker's son

Dunno how it works there, but I know that here, there has to be tax paid on the car when it changes hands, even if you give it away. Only caveat there is if the transfer is to an immediate family member, you don't have to pay the taxes then. Liability wise, I would imagine that if the car is in the new person's name, and they assume responsibility (don't you need to safety the car before changing registration or something?) and it's their problem. Unless you're talking about keeping the car in your name, and just letting them drive it around?

I once gave a car to a neighbor. I just signed the title over to him and that was it.

Make sure you put it in their name. If they break down on the road and it gets towed you may get saddled with the towing and storage bill. As far as personal responsiblity goes, I do not think so, but sell it for a dollar to be safe.

I would gift the car to them and they would have to register it and so on when the car was given to me, it was from my cousin and I didn't have to pay taxes....

Ontario rules are stupid and archaic. I don't know how much of the original value is charged again in taxes over the lifetime of a normal car, but it's something like 4x the original value. Highway robbery.

gift from a family member is often viewed differently than a gift from an unrelated person, at least here they make you pay taxes on the blue book value of the car. but that's not your problem, sign over the title, give the kid the car with a bill of sale that says you are giving it as a gift, and hold no responsibility to the car from this day forward.

i wouldn't "gift" it due to tax issues, regardless of how little it's worth. sell it for $1 or something.

Yes. Good for them too. They pay taxes based upon the value of the car. if it's a gift they get stuck with blue book or close to it. If it is a sale they pay taxes on a dollar. I bought a car from my girlfriend. We did this in CA and it worked out great. The relationship not so much.

THIS! and what ever you do, make sure it is written in the Bill of Sale **AS IS**! it varies state to state, but unless there is proven negligence, you would be fine if they wrecked it two days later. i know in MA, you are free and clear from just about everything doing that. this dumb bitch i sold a car to snapped the front drivers side wheel off and totaled the car a week later. lucky for me, i had *as is* written just right...i was told that without that, it would have been my responsibility for 30 days. as an added bonus she had 2 speeding tickets on her road littered with potholes...one of which was what caused her to snap the wheel off.

like others have said "sell it" more than a dollar but less than say a grand. Make sure AS IS is on the bill of sale. In Louisiana that covers your arse of everything.

I don't think you do, unless it was rigged to explode or something You might want to tell them about it too, maybe that will clear you of liability right there

I have "sold" two cars in the last two years for $1 each and they weren't even questioned about it at the DMV. I did make sure that the new owners registered the vehicle and returned my license plate to me.
