No death penalty in VT... but jeez this case looks super easy... the lady called her ex telling them the snow plow people broke down... her little kid even said that mommy started crying and grabbed his neck... and her car was still running when police found the kid.
How would you say that it was not pre-meditated... that your car broke down... call someone to help... just get enraged when you see them strangle them out of the car... then your car magically starts again and throw the body in the back seat...

My guess on this: they said more charges could be coming. You can only hold someone for 72 hours without charging them. I suspect they will charge them with 1st degree murder, they just didn't want to take the chance and let them go. They still need to build their case for 1st degree murder but 2nd degree was a slam dunk.

Sure as hell does look like first degree. But I see the penalties for 1st and 2nd degree are the same, left up to the judge.

As emotionally repugnant as this case is, it doesn't meet with my criteria for capital punishment, which are crimes of mass physical or economic destruction, or the commission of murder (not while self defense) while incarcerated. (I know I need to elaborate more on those but I'm not going to right now)
Condolences to the family and I hope her children are well cared for.

I'm against capitol punishment for all but a few offenses (Genocide, Mass Murder, High Treason). I would pass the Witherspoon Test and still not vote for capitol punishment, even if the facts of this case are exactly as presented.
Reasoning:
1) According to Black's Death Penalty Case Law, Vol 3, over 90% of Americans have no idea what the Witherspoon Test is whereas almost everyone has a strong opinion on capitol punishment.
2) My personal impulses want a lot of people dead - from these schmucks to rapists, rascists, the drug dealers down the street, every moron that thought invading Iraq was a great idea, and definitely to Westboro Baptists. But if my impulses directed my actions, I would be a monster and so would almost everyone I've ever met.
3) Taking 2) a little higher up, this is a calculated, time consuming, considered effort to kill other people and deem it Justice whereas it is really a poor excuse to take the opportunity to sink to the moral level of the perpetrators. An execution is not the same as thinking someone should be dead for a lot of reasons: this is one of them.
4) It doesn't bring the victim back or offer any protection or immunity to potential future victims.
5) The fact that reason does not change anyone's mind when it comes to this issue is precisely why it should be abolished.
