Subject: Facebook is going to start taking companies to court, that ask for usernames/passwords.
In recent months, we’ve seen a distressing increase in reports of employers or others seeking to gain inappropriate access to people’s Facebook profiles or private information. This practice undermines the privacy expectations and the security of both the user and the user’s friends. It also potentially exposes the employer who seeks this access to unanticipated legal liability.

The most alarming of these practices is the reported incidences of employers asking prospective or actual employees to reveal their passwords. If you are a Facebook user, you should never have to share your password, let anyone access your account, or do anything that might jeopardize the security of your account or violate the privacy of your friends. We have worked really hard at Facebook to give you the tools to control who sees your information.

As a user, you shouldn’t be forced to share your private information and communications just to get a job. And as the friend of a user, you shouldn’t have to worry that your private information or communications will be revealed to someone you don’t know and didn’t intend to share with just because that user is looking for a job. That’s why we’ve made it a violation of Facebook’s Statement of Rights and Responsibilities to share or solicit a Facebook password.

Facebook takes your privacy seriously. We’ll take action to protect the privacy and security of our users, whether by engaging policymakers or, where appropriate, by initiating legal action, including by shutting down applications that abuse their privileges.

The obvious BTified reply here would be:
Don't apply for jobs asking for a Facebook Username/password.

New Jersey is going to pass a law which makes it unlawful to ask for your password/user name and even make it unlawful for an employer to even ask if you are on a social media site.

I do not use facebook (any social media asides from VN) but I like the law.

Employers in this state are not allowed to ask your age, if you are married, have a medical condition, are gay, etc and this can all be seen with employers getting your log in. The employer is technically breaking hippa laws, discrimination laws and possibly other laws by seeing your page.

Edit: I want to see my prospective employers page though. I want to know what kind of a person I am going to work for. wink Lets see how far that gets.

Yes, they really are, especially employers that are involved in any kind of law enforcement and/or require security clearances.

Wait so they are going to start suing users?

Prospective employers have no relation with FB... the user would be the one violating the contract...

Then it would be OK if I asked for your bank information? Because, you have an account at the bank, I don't.

no the companies that require it as a condition of employment.

and shuttering a companies facebook site and apps that use facebook info is a option they may use along with legal proceedings.

they cant legally ask to access to your private email password, so why should employers be able to access your social network account?

yep if a potential employer knows this info and your in one of those "protected" groups, and dont get hired its a discrimination lawsuit.

It isn't just employers. When you join any college club, sport, or other activity they now have someone whose job it is to keep tabs on social media and you are usually required to either give them login info or "friend" them.

Its insane how anyone gets away with this to begin with.

i don't have a facebook account with my actual name attached to it. so not only would they get jack shit on me if they searched for me, they also would get told to go fk themselves and i'd report that shit to every media outlet i could.

How is this any different than a prospective employer pulling your credit rating?

That would be analogous to the employer searching for you on facebook, not accessing your facebook with your login.

To go with your statement, it would be kinda like the difference between doing a credit check on you and using your credit card to buy stuff.

There isn't a job out there that would be worth me voluntarily handing out a username and password to any social media site.

It's amazing what people think they can get away with simply because they are thinking of employing someone. Recessions are not only tough on families, they are tough on civil liberty and privacy. Sad thing is, they push this stuff long enough...and everyone just shrugs and says, "whatever" and accepts it.

I'm so glad I'm retired, I'd probably end up murdering everyone in management of any company I applied to that demanded access to my private life in order to be considered for possible employment.

I remember the first time someone said they were going to check my credit rating as a matter of course in the interview process. I laughed at them and they got all glowery and pissy, so I realized they were serious, and I laughed even harder as I walked out, thinking to myself, "what a bunch of idiots, no one is going to allow that".

Here it is 20 years later and almost everyone not only accepts it, they defend it and think it's reasonable. What a load of horse crap. Some of the best employees I ever had got cars repo'd every year or so and couldn't get a credit card to save their lives. Their personal finances were none of my business and had absolutely nothing to do with how they did their jobs, and yes this includes people who dealt with large amounts of cash and accounts receivable and payable. Work and personal life have almost nothing in common. Hell, I had an account manager who got a mink coat repo'd at the office once. That was hilarious. Never knew they would repo a coat, but I guess it did cost more than many cars.....
