Judge Martin stated that the First Amendment of the Constitution does not permit people to provoke other people. He also called Perce, the plaintiff in the case, a "doofus." In effect, Perce was the perpetrator of the alleged assault, in Judge Martin's view, and Elbayomy the innocent. The Sharia law that the Muslim attacker followed trumped the First Amendment.

There should have been a trial.
If the evidence wasn't sufficient to prove there was an assault he would be found not guilty. I think there was at least a reasonable question as to whether or not an assault had occurred.
Also, I would be more concerned with making an armed and xenophobic culture feel as though they had no legal recourse in protecting themselves when expressing their views than with religious obligations of someone.

The judge made the correct ruling.
The plaintiff told police that the man attacked him the day of the incident, then he told other police the next day that the man didn't touch him but confronted him and verbally accosted him, then he testified under oath that the man attacked his fake beard AFTER he himself tore it off to yell at the accused.
There was no physical evidence of an attack. No bruises or contusions and no visible damage to any items of clothing or the fake beard. It was some guy saying he attacked me, well he yelled at me, well he attacked my fake beard....sorta.
Case dismissed.
Where the judge screwed up was in attempting to moralize to the two idiots involved. The judge himself sounds like an idiot when doing so, but he never said Sharia Law trumps the first amendment, he said hiding behind the first amendment in order to provoke and demean others wasn't a very good idea, or nice. Well DUH.....but it isn't a judges job to give his opinion on such matters to either side in a dismissed case and opens him up to the kind of manufactured outrage and faux shit storm we are seeing here.

How many of you would cheer if a serviceman punched out one of the Westboro Church idiots if they were protesting at one of his buddy's funeral?
At worst, a guy was punched, but, the evidence for that is pretty inconclusive. If this had been, say, a fight outside a bar, the police probably wouldn't even have arrested anyone.
Now, if the alleged attacker ad actually hurt the other guy, that would be a different matter, though, unless it was a serious injury, even then, the guy would probably have been let off with a warning.

The Constitution grants me the right to free expression. But I know that if I call a group of tough looking black youths the N word and talk about their mothers that I deserve the beating I'd get. Can I open up a little bacon cheese burger cart in front of the mosques?
I heard there is a big crowd outside of these mosques after their services (which are like ten times a day, helllo!!!!). And I know how breakfast places near churches are always busy on Sundays (and some of them are also busy Wednesday nights, maybe a martini bar?).... I was thinking since they get out of their martyr indoctrination courses, in the afternoon, they might need some pick me up, some energy, a pre-meal snack if you will...
Anyway, I think I could turn this into a chain cart place thing and make tons of mad cash!!!

The principle is. I should make it clear that I support the guy's right to dress as zombie Mohammed or what ever he did and it was stupid of the other guy to attack him. If there had been an injury, I fully support the attacker being charged and tried. But, it seems that the worst that might have happened is a guy got shoved. Something like that should never end up in Court.
If the typical Outposter was a judge and some guy came in whining that a mean guy had shoved him because the first guy was making fun of him, the lecture would have been very similar to what the judge said...man up, you wimp.

I think it's funny how people are willing to shade their definitions of assault and harassment when it comes from one direction and not from another.
If the guy wearing the costume was attacked, or threatened, or harassed, it was a crime, period. It would be just as much of a crime if the alleged attacker had been spouting off about his 72 virgins for when he dies suicide bombing some infidel target and someone attacked him for doing so too.
