A New Hampshire man who fired his handgun into the ground to scare an alleged burglar he caught crawling out of a neighbor's window is now facing a felony charge -- and the same potential prison sentence as the man he stopped.

Dennis Fleming, 61, of Farmington, was arrested for reckless conduct after the Saturday incident at his 19th century farmhouse. The single grandfather had returned home to find that his home had been burglarized and spotted Joseph Hebert, 27, climbing out of a window at a neighbor's home. Fleming said he yelled "Freeze!" before firing his gun into the ground, then held Hebert at gunpoint until police arrived.

"I didn't think I could handle this guy physically, so I fired into the ground," Fleming told FoxNews.com. "He stopped. He knew I was serious. I was angry … and I was worried that this guy was going to come after me."

No one was injured in the incident, but when the police arrived, they made two arrests. Hebert was charged with two counts of burglary and drug possession. He faces up to seven years in prison if convicted. Fleming, meanwhile, is scheduled to be arraigned March 20 on a charge of reckless conduct, which could potentially land him a sentence similar to the one Hebert faces.

"I didn't know it was illegal [to fire into the ground], but I had to make that guy realize I was serious," Fleming said. "I've got a clean record. I really don't want to be convicted."

Only an idiot would think this guy will get a sentence handed down. They are only doing this to clear the issue up. Standard procedure in many cases. Once he is cleared it can never come back on him again. And, they will run it quickly thru the court system before the perp goes to court. Then the prosecutor has that info to strengthen his case showing the farmer did everything right as he went into court and was cleared. But I love how the media tries to play on this crap then stupid people read it and believe he is in trouble.

For sure, which is they released him on his own recognizance no bail.

It is pretty common when a crime is committed, which this is, to arrest both parties and figure it out at the station.

Because this is a little complex, I am sure they are looking at it so they don't set a law changing precedent, which in the worst case will result in a misdemeanor and fine.

The law is the law, right? At least that is what all you right-wingers like to assert when someone you don't like gets arrested or beat up.

If the guy's life was threatened, I don't think he would have been arrested even, but that was not the case.

You don't get to kill somebody, now off your property who has stolen some minor crap from your home.

It really is that simple.

hehe I don't take it personal at all.

I've lived there for around 18 years of my life, two different towns, the rest of my time in various towns in MA.

The last stint I lived there 10 years and when I moved back to MA two years ago, I had talked to more neighbors in the first month than I ever did in NH.

I can't stand MA politicians, taxes, liquor laws, etc
I can't order a pocket knife online and have it shipped to me in MA.. just stupid

NH can be very cold to outsiders, and there are a lot of inbred twats that live there as well. But I love the fact that I can order anything I want through the mail, can get alcohol anywhere, the towns are smaller mostly and the landscape is just awesome.

I don't begrudge anyone for not wanting to live there, it's definitely not for everyone.
My wife hated the short time she lived there with me lol.

I keep threatening to move us to where my Mom came from. Talk about boonies.. there was only 7 people in her graduating class.

People are trying to tell me shooting a gun at a drug addict stealing minor possessions from your neighbors house is not reckless.

What if this dude had a gun himself? What if he shot back missed and hit your kid across the street... guess it is okay because you were attempting to save your neighbor $20.

The criminal being alive is testament to poor aim, not a lack of deadly force. Releasing that force with an intent other than to kill is reckless. Warning shot, negligent discharge, or crappy aim; he discharged a firearm in the direction of a living thing. If you're not willing to kill it, your finger shouldn't even be on the trigger.

No one but the e-vigilantes here would try to justify something as idiotic as a warning shot. He should get off with minimal punishment because the results were benign and his intentions were good not because you morons think he's justified...
